1. Agreement to Terms

Welcome to Yitaku. These Terms and Conditions (the "Terms") govern your use of the Yitaku website at www.yitaku.com, the Yitaku mobile application (available on iOS and Android), and the Yitaku seller portal at portal.yitaku.com (together, the "Service"), all operated by Yitaku Limited ("Yitaku", "we", "us", or "our"), a company registered in Malta with company registration number C101893.

Please read these Terms carefully. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. They should be read together with our Privacy Policy and Cookie Policy, which form part of your agreement with us.

2. Eligibility

To use the Service, you must be at least 18 years old. By creating an account or using our Service, you confirm that you are at least 18 years old, or that you are the parent or guardian of a minor and consent to that minor's use of the Service under your supervision.

You must also not be:

  • A person barred or otherwise legally prohibited from receiving or using the Service under the laws of the country in which you are resident or from which you access the Service
  • Subject to international sanctions or embargo

If you are using the Service on behalf of a company, organisation, or other legal entity (for example, an estate agency, a property development firm, or a partnership), you confirm that you have the authority to bind that entity to these Terms, and references to "you" in these Terms include both you personally and the entity you represent.

3. What Yitaku is, and what Yitaku is not

Yitaku is a real estate marketplace platform. We provide infrastructure that allows:

  • Sellers, agents, and developers to publish property listings
  • Property seekers (buyers and renters) to discover, search, and enquire about properties
  • Both parties to communicate about specific properties through our platform

Yitaku is a marketplace provider, not an estate agent, broker, or property intermediary. We do not:

  • Act as a real estate agent under the Estate Agents, Property Brokers and Property Consultants Act
  • Verify the legal status, ownership, or accuracy of listings
  • Provide advice on property purchase, sale, or rental decisions
  • Negotiate, broker, or facilitate transactions between buyers and sellers
  • Take possession of or hold deposits, payments, or proceeds of property sales
  • Guarantee the accuracy of any information displayed on the platform, including but not limited to property descriptions, prices, photographs, locations, or seller details

Property transactions occur directly between buyers and sellers (or their respective agents and professional advisors). Yitaku's role is limited to providing the platform on which listings are displayed and through which initial contact is made.

You acknowledge that any decision to purchase, rent, sell, or otherwise transact in property is your own decision, made on your own responsibility, after such professional advice (legal, financial, technical) as you consider appropriate.

4. User Accounts

4.1 Creating an account

To access certain features of the Service, including publishing listings or submitting enquiries, you must create an account. When you create an account, you must provide information that is accurate, complete, and current. You must update this information as it changes.

You are responsible for:

  • Safeguarding the password you use to access the Service
  • All activities that occur under your account
  • Notifying us immediately at info@yitaku.com if you become aware of any unauthorised use of your account or any other breach of security

You must not share your account credentials with any third party, transfer your account to another person, or impersonate any other user or person.

4.2 Account types

The Service supports several account types:

  • Property seekers — individuals using the website or mobile app to discover properties, save searches, and contact sellers
  • Sellers — private individuals listing one or more properties for sale or rent
  • Agents and developers — professional users listing multiple properties on behalf of themselves or others
  • Enterprise clients — agencies and developer firms using the platform with multiple team members under a single subscription

Different account types may have different features, billing arrangements, and obligations under these Terms.

4.3 Account suspension and termination

We may suspend or terminate your account in accordance with Section 13 of these Terms.

5. Listings — content terms

This section applies to users who publish property listings on the Service (sellers, agents, and developers).

5.1 Your content remains yours

When you publish a property listing on Yitaku — including text descriptions, photographs, floor plans, videos, and other materials (your "Content") — you retain ownership of that Content. Yitaku does not claim ownership of your Content.

5.2 Licence you grant to Yitaku

By publishing Content on the Service, you grant Yitaku a worldwide, non-exclusive, royalty-free, transferable, sub- licensable licence to:

  • Host, store, display, reproduce, and distribute your Content on the Service
  • Use your Content in marketing and promotional materials for the Service (including but not limited to social media posts, advertising, search results, and editorial features showcasing the platform)
  • Retain your Content after a listing is removed for the purposes of historical reference, market data, internal records, and dispute resolution
  • Allow other users of the Service to access, view, and contact you about your listings

This licence is granted for the duration of your account and survives the removal of any individual listing for the limited purposes set out above (marketing, market data, records, dispute resolution).

You may withdraw any specific Content from public display at any time by removing the relevant listing. Removing the listing terminates the display licence for that Content on the Service but does not terminate the licence for the limited purposes that survive removal.

5.3 Your representations about Content

By publishing Content on the Service, you represent and warrant that:

  • You own the Content or have all necessary rights to publish it on the Service, including any photographs, descriptions, or third-party materials
  • The Content is accurate, current, and not misleading
  • You have the legal right to offer the property described in the listing for sale, rent, or other transaction (whether as owner, authorised agent, or under another valid legal arrangement)
  • The Content does not infringe any third party's intellectual property rights, privacy rights, or other rights
  • The Content does not contain unlawful, defamatory, threatening, harassing, or otherwise objectionable material
  • The Content complies with all applicable laws, including Maltese consumer protection law, advertising standards, and real estate regulations

5.4 Content moderation

Listings are typically published immediately when you submit them. Yitaku does not pre-review every listing before publication, and our publication of your listing does not constitute endorsement, verification, or approval.

Yitaku reserves the right, at our sole discretion and without notice, to:

  • Refuse to publish, edit, or remove any Content that we consider violates these Terms, applicable law, or our community standards
  • Suspend or terminate the account of any user who repeatedly publishes Content that violates these Terms
  • Report unlawful Content to relevant authorities

Examples of Content we may remove include (but are not limited to): listings with materially false information, listings for properties the user has no right to list, listings containing offensive or discriminatory language, duplicate listings, and listings used to circumvent platform fees or features.

6. Subscriptions and Payments

6.1 Pricing tiers

Yitaku offers three commercial tiers for sellers, agents, and developers:

  • Personal — a one-time payment per property listed, suitable for private owners listing individual properties
  • Professional — a recurring subscription (billed monthly or annually) with included listing capacity, suitable for active sellers and agents
  • Enterprise — a custom contract with terms negotiated individually, suitable for agencies and developer firms

A free tier is also available, with limited features. Up-to- date pricing for each tier is published at www.yitaku.com/pricing.

All prices are quoted exclusive of Value Added Tax (VAT). VAT will be added to the displayed price where applicable at the rate prevailing at the time of purchase.

6.2 Payment processing

Payments are processed by Stripe Payments Europe Limited, a third-party payment processor. By making a payment through the Service, you also agree to Stripe's terms and conditions and privacy policy.

Yitaku does not store full payment card details on our systems. We receive limited transaction metadata (such as transaction ID, amount, and payment status) for our records.

6.3 Personal tier — one-time listing payments

Personal tier listings are charged on a per-listing basis. Each new property listed incurs a separate one-time fee. Personal tier purchases are not subscriptions and do not auto-renew.

A Personal tier listing remains live for the period specified at the time of purchase. To list additional properties, you must complete a new purchase for each property.

6.4 Professional tier — recurring subscriptions

Professional tier subscriptions are billed in advance on a monthly or annual cycle, depending on the billing option you select at sign-up. Annual subscriptions are offered at a discount to monthly billing.

Professional subscriptions automatically renew at the end of each billing period, at the then-current rate, unless you cancel before the renewal date. We will send a reminder email before annual renewals.

6.5 Enterprise tier

Enterprise contracts are governed by the specific terms agreed in writing between Yitaku and the enterprise client. Where the Enterprise contract is silent on a matter, these Terms apply.

6.6 Cancellation and refunds

You may cancel a Professional subscription at any time through your portal account settings. Cancellation takes effect at the end of your current billing period, and you retain access to your subscription benefits until then.

We do not provide refunds for:

  • Unused subscription time after cancellation
  • Partial billing periods
  • Features included in your plan but not used during the billing period
  • Unpublished listings on the Professional or Enterprise tier
  • Coupon redemptions or coupon-related benefits

Personal tier refunds: For Personal tier one- time listing purchases, refunds are not provided once the listing has been published. If you have paid for a Personal tier listing but no listing has been published, you may request a refund within 14 days of purchase by contacting info@yitaku.com.

Refunds where Yitaku is at fault: If Yitaku is unable to provide the subscription benefits you paid for due to a material failure on our side (for example, an extended platform outage), we may offer a pro-rata refund or credit at our discretion.

6.7 Price changes

Yitaku reserves the right to change subscription prices. Price changes affecting existing subscriptions will take effect at the start of the next billing period following at least 30 days' notice. If you do not agree to the new price, you may cancel your subscription before the next billing period begins.

6.8 Failed payments

If a payment fails (for example, due to card expiry or insufficient funds), we may suspend access to paid features until payment is successfully processed. We may retry failed payments according to Stripe's standard retry schedule. Repeated payment failure may result in subscription termination.

7. Buyer enquiries and lead routing

When you submit an enquiry about a property listed on the Service (whether by message, contact form, or other means), the following information is shared with the seller, agent, or developer who published the listing, so they can respond to your enquiry: your name, surname, email address, mobile number, the content of your enquiry, and the property your enquiry relates to.

This applies to all listings on the Service, regardless of who originally supplied the listing.

You acknowledge that:

  • The recipient of your enquiry is the seller, agent, or developer, not Yitaku
  • Yitaku does not control how the recipient uses your contact details once shared
  • Yitaku does not guarantee any response, response time, or quality of response from the recipient
  • Any subsequent communication, viewing, or transaction takes place directly between you and the recipient

Sellers, agents, and developers who receive enquiries through the Service agree to handle buyer contact details in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR).

8. Insurance quote requests

Yitaku offers a feature that allows you to request insurance quotes through our platform. When you submit a quote request, your contact details (name, surname, email, and mobile number) are forwarded to the insurance provider you select.

Yitaku is not an insurance broker, agent, or intermediary. We do not underwrite, advise on, or arrange insurance contracts. The relationship for any insurance product, including the terms, premiums, coverage, and any disputes, is solely between you and the insurance provider you select.

Yitaku takes no responsibility for:

  • The accuracy of any quote provided by an insurance provider
  • The suitability of any insurance product for your needs
  • The terms, conditions, exclusions, or coverage of any insurance contract entered into
  • The conduct of any insurance provider listed on the Service
  • The outcome of any claim under any insurance contract

You should review the terms of any insurance product carefully and seek independent advice before purchasing.

9. My Coupons Feature

Yitaku offers a "My Coupons" feature that allows users to access promotional offers from third-party partners. The following terms apply to all coupons accessed or used through the Service:

  • Coupons are non-transferable, non-exchangeable, and cannot be redeemed for cash
  • Coupons must be presented at the time of purchase to be valid
  • Coupons are valid for one-time use only, unless otherwise specified
  • Expired coupons will not be honoured
  • Yitaku reserves the right to cancel or modify coupons and their terms at any time without prior notice
  • Coupons cannot be used in conjunction with any other offer, discount, or promotion unless expressly stated
  • Coupons are subject to availability and Yitaku reserves the right to substitute a coupon with another of equivalent value without prior notice

Yitaku is not responsible for technical failures or any other factor beyond our reasonable control that may affect the operation of the coupon feature.

Any attempt to undermine the legitimate operation of the coupon feature — including tampering, fraud, or violation of these Terms — may be a violation of criminal and civil law. Yitaku reserves the right to seek damages from any such person to the fullest extent permitted by law, and to disqualify any user found to be acting in violation of these Terms.

The redemption of any coupon is a transaction between you and the third-party partner offering the coupon. Yitaku is not a party to that transaction and takes no responsibility for the goods or services provided by the third-party partner.

10. Acceptable Use

You agree not to use the Service:

  • For any unlawful purpose, or to solicit others to perform or participate in any unlawful acts
  • To violate any international, EU, Maltese, or other applicable laws, regulations, or rules
  • To infringe upon or violate Yitaku's intellectual property rights or the intellectual property rights of others
  • To harass, abuse, threaten, defame, or otherwise harm any other person
  • To submit false, misleading, or inaccurate information
  • To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • To solicit other users' personal information for purposes unrelated to legitimate property enquiries
  • To send spam, chain letters, junk mail, or other mass unsolicited communications

10.1 General restrictions

In addition, you may not:

  • Modify, copy, reproduce, or create derivative works from any material on the Service, except for your own listings
  • Use any material from the Service for commercial purposes without our prior written consent
  • Decompile, reverse-engineer, disassemble, or otherwise attempt to derive the source code of any software contained on the Service
  • Remove any copyright or other proprietary notations from any material on the Service
  • Transfer any material from the Service to another person, or "mirror" the material on any other server

10.2 Platform-use restrictions

You may not:

  • Use automated devices, software, scripts, robots, or other means to access, retrieve, scrape, or index the Service or its content
  • Use any means to interfere with the proper working of the Service, including bypassing rate limits, security measures, or access controls
  • Use any content or data from the Service to construct or populate a searchable database of properties, build a database of property information, or otherwise compete with Yitaku in any manner not specifically authorised
  • Transmit any viruses, malware, worms, or other destructive code through the Service
  • Attempt to gain unauthorised access to any part of the Service, including other users' accounts, computer systems, or networks connected to the Service

10.3 Consequences of violation

Engaging in any prohibited activity may result in:

  • Removal of your Content
  • Immediate suspension or termination of your account
  • Civil action for damages
  • Referral to law enforcement authorities
  • Other remedies available to Yitaku under applicable law

11. Intellectual Property Rights

The Service and its original content (excluding Content provided by users), features, and functionality — including the design, layout, look and feel, branding, software, source code, and Yitaku-authored editorial content — are and will remain the exclusive property of Yitaku Limited and its licensors. All rights are reserved.

The Yitaku name, the Yitaku logo, and other Yitaku marks, trademarks, and trade dress may not be used in connection with any product or service without the prior written consent of Yitaku Limited.

Nothing in these Terms grants you any right, title, or interest in or to the Service or its content, except for the limited right to use the Service as expressly permitted by these Terms.

12. Links to Other Websites and Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Yitaku, and may integrate with third-party services (including but not limited to Stripe for payments, Google Maps for property locations, and YouTube for video content).

Yitaku has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We are not liable for any loss or damage caused by or in connection with your use of any third-party website or service.

We encourage you to read the terms and conditions and privacy policies of any third-party website or service you access through the Service.

13. Termination

We may suspend or terminate your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion acting reasonably and in good faith, for any of the following reasons (without limitation):

  • A breach of these Terms
  • A breach of applicable law
  • Conduct that we consider, in our reasonable judgment, to be harmful to other users or to Yitaku
  • Repeated payment failure
  • Extended account inactivity
  • Court order or regulatory request

Upon termination:

  • Your right to use the Service ceases immediately
  • We may remove your Content from the Service
  • Provisions that by their nature should survive termination will survive, including (without limitation) Sections 5.2 (licence to Yitaku), 11 (intellectual property), 14 (indemnification), 15 (limitation of liability), and 17 (governing law)

If you wish to terminate your own account, you may do so at any time through your account settings or by contacting info@yitaku.com.

14. Indemnification

You agree to defend, indemnify, and hold harmless Yitaku Limited and its directors, officers, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising out of or in connection with:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your Content caused damage to a third party
  • Any inaccuracy or misrepresentation in your listings or other Content

This indemnification obligation will survive termination of these Terms and your use of the Service.

Nothing in this Section 14 shall operate to exclude or limit any rights you may have as a consumer under Maltese or EU law, including but not limited to the Consumer Affairs Act (Chapter 378 of the Laws of Malta). Where you are using the Service as a consumer, the indemnification obligations in this section apply only to the extent permitted by applicable consumer protection law.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided on an "as is" and "as available" basis. Yitaku makes no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, non- infringement, or that the Service will be uninterrupted, error-free, or secure.

Property listing accuracy. Yitaku does not warrant the accuracy, completeness, or reliability of any listing or Content on the Service. Property descriptions, prices, photographs, and other listing information are supplied by sellers, agents, and developers, and Yitaku does not independently verify them. You acknowledge that any reliance you place on listing information is at your own risk, and that property transactions should be conducted with appropriate professional advice (legal, financial, and technical).

Indirect and consequential losses. In no event shall Yitaku Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to, use of, or inability to access or use the Service
  • Any conduct or content of any third party on the Service, including any seller, agent, developer, or other user
  • Any content obtained from the Service, including listings and editorial content
  • Unauthorised access to or alteration of your transmissions or content
  • Any property transaction entered into following an enquiry made through the Service
  • Any insurance product purchased following a quote request made through the Service

Aggregate liability. To the maximum extent permitted by law, Yitaku's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the amount you have paid Yitaku in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (€100).

Nothing in these Terms excludes or limits Yitaku's liability for:

  • Death or personal injury caused by Yitaku's negligence
  • Fraud or fraudulent misrepresentation by Yitaku
  • Any other liability that cannot be excluded or limited under applicable Maltese or EU law

16. GDPR and Data Protection

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and the Maltese Data Protection Act (Chapter 586 of the Laws of Malta).

You have the right to access, correct, request deletion of, or object to the processing of your personal data, as set out in our Privacy Policy. To exercise these rights, please contact us at info@yitaku.com.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Malta, without regard to its conflict-of-law provisions.

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Maltese courts, save where applicable consumer protection law gives you the right to bring proceedings in another jurisdiction.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18. Changes to These Terms

Yitaku reserves the right, at our sole discretion, to modify or replace these Terms at any time.

For routine updates (clarifications, formatting, or non-material changes), the updated Terms become effective when published on the Service. Your continued use of the Service after publication constitutes acceptance of the updated Terms.

For material changes (changes that materially affect your rights or obligations, including price changes, refund policy changes, or significant changes to acceptable use), we will provide at least 30 days' notice before the changes take effect, by email or by prominent notice on the Service. Where required by applicable law, we will obtain your explicit acceptance of the material changes before they apply to you.

What constitutes a "material" change will be determined at our sole discretion, applied in good faith.

We will update the "Last updated" date at the top of these Terms when changes are made. We encourage you to review these Terms periodically.

19. General Provisions

Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Yitaku regarding your use of the Service, and supersede any prior agreements between you and Yitaku on the same subject matter.

No waiver. Yitaku's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without Yitaku's prior written consent. Yitaku may assign these Terms freely.

Force majeure. Yitaku is not liable for any failure or delay in performance caused by events outside our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic, natural disaster, internet outages, or third-party service failures.

Language. These Terms are written in English. Any translation provided is for convenience only; the English version prevails in case of conflict.
