Freehold

A freehold owner holds the property outright and indefinitely, without time limits or ongoing payments to a third party. Freehold ownership is the standard form for most residential property purchases in Malta and is distinguished from ground rent (ċens) tenure, where annual payments are due to a landowner.
In Maltese property law, ownership structures derive from the Civil Code (Chapter 16 of the Laws of Malta). Freehold — sometimes referred to as full ownership or dominium directum et utile — is the most complete form of title. The owner has the right to use, modify, lease, sell, or bequeath the property, subject only to general legal restrictions (planning law, building regulations, etc.).
This is distinct from properties held under ground rent (ċens), where the underlying land remains owned by a different party (the ċens holder) and the property owner pays an annual ground rent in perpetuity or until the ground rent is redeemed.
Why freehold matters in a purchase. When buying a property, one of the notary's key due diligence tasks is verifying the form of title — confirming whether the property is freehold, subject to ground rent, or held under some other arrangement. This affects:
- Total cost of ownership — freehold has no ongoing payments to a landowner; ground rent does
- Resale value — freehold properties typically command a premium over comparable ground rent properties
- Mortgage availability — some banks treat freehold and ground rent properties differently for lending purposes
- Future flexibility — ground rent can sometimes be redeemed (converted to freehold) by paying a lump sum to the ċens holder, but this depends on the original deed terms
A notary's title search will identify the form of ownership and flag any ground rent obligations attached to the property.
